Terms and conditions

ACCEPTANCE OF TERMS :

By placing an order with our Company you agree to be bound by the terms and conditions set out herein. These remain applicable notwithstanding any clause on the ordering form of the buyer or any other document.
Any dispensation from these terms and conditions must have been previously agreed to in writing.

 

PROTECTION OF MINORS :

In accordance with the article L.3342-1 of the “Code de la santé publique”, the sale of alcohol to minors under 16 is prohibited in France. Anyone wishing to purchase alcoholic drinks from the Company SCV LES VIGNOBLES DE CONSTANCE ET DU TERRASSOUS declares to be over 16 at the moment of ordering and to provide his/her real date of birth in the space provided on the ordering form.

 

DATA PROTECTION :

No personal information is collected without the user knowing, no information is passed to third parties or used to different ends to those planned. In accordance with the article 27 of the law number 78-17 from January 6th on data protection, you have a right to access and rectify your personal information. ACCEPTANCE OF ORDERS :

The sale contract will only be finalised after the acceptance and confirmation of the order by SCV LES VIGNOBLES DE CONSTANCE ET DU TERRASSOUS (by sending a receipt by mail, fax or post). The company S.C.V SCV LES VIGNOBLES DE CONSTANCE ET DU TERRASSOUS shall not be liable for the photographs used to illustrate the products as they are for information only. By placing an order the Buyer renounces the rights of the article 1587 of the “Code Civil”. Any order placed on line and validated according to the process set out is final and definite, unless using the legal right to retract. Validating the ordering form implies the acceptance of any condition appearing on the screen such as the name and details of the products, quantities and prices. The system used by the SCV LES VIGNOBLES DE CONSTANCE ET DU TERRASSOUS is considered to be the only proof of the type, contents and date of the order.

The company SCV LES VIGNOBLES DE CONSTANCE ET DU TERRASSOUS reserves the right to not confirm an order and consequently not process a payment for any cause beyond the company’s control (particularly for a non-compliance of the terms and conditions, shortage of stock, dispute arising from a previous order).

 

RIGHT TO RETRACT :

In accordance with the article L.121-20 of the “Code de la consommation”, the Buyer is entitled to seven full days from the time of the order to use his right to retract and to return the products to the Seller, to be exchanged or refunded, without penalty, except for post and packaging fees. The goods must be returned in a perfect condition in their original packaging and through the carrier appointed by the company SCV LES VIGNOBLES DE CONSTANCE ET DU TERRASSOUS.

 

DELIVERIES :

We only deliver in mainland France (no deliveries in Corsica).

For deliveries outside of France please contact us by mail at Société Coopérative Vinicole “LES VIGNOBLES DE CONSTANCE ET DU TERRASSOUS” BP 32 66302 Thuir Cedex or by email oncontact@terrassous.com.

Deliveries can be made to your home address, place of work or any other address mentioned on the ordering form. However, the entire delivery will be made to one address only. Deliveries are made from Monday to Friday (no deliveries on Saturdays, Sundays or bank holidays).

Please inform us if you have a specific deadline for the reception of your wines. If we are not able to meet this deadline we will contact you before sending the wines. Delivery dates, when indicated, are target dates only. Delays in delivery - unless otherwise mentioned by an agreement between the two parties, shall not entitle the Buyer to cancel the order or claim compensation. Deliveries usually take about two weeks for mainland France from the reception of the order. It is the Client’s responsibility to check the goods supplied upon receipt.

Damage or partial deliveries :

The client must report in writing on the carrier’s delivery note any damaged or missing products, as the carrier is the only person liable for damaged goods. According to the article L.133-3 of the “Code de commerce” claims have to be confirmed in writing to the carrier by postal recorded delivery within 3 days of reception of the goods. A copy of the claim must also be addressed to SCV LES VIGNOBLES DE CONSTANCE ET DU TERRASSOUS.

 

FORCE MAJEURE :

The company SCV LES VIGNOBLES DE CONSTANCE ET DU TERRASSOUS shall not be responsible for any failure to perform or delay in performance due to unforeseen circumstances or to causes beyond the company’s control such as floods, fire, strikes, lock outs…

 

TRANSPORT :

Whichever means of transport or payment has been chosen (franco or at the reception of the goods), the company SCV LES VIGNOBLES DE CONSTANCE ET DU TERRASSOUS shall not be responsible for any problem occurring during the transport of the goods

 

AVAILABILITY OF GOODS :

The wines and goods advertised are only available if they are visible on the website and in stock.
In case of unavailability we can offer another vintage year or a full or partial refund of your order. The refund will then be made by cheque or bank transfer.

 

PRICES :

Our bottled wines are exclusively sold in boxes of 6 bottles. The selling price is correct at the time of ordering, i.e. the price indicated by the Seller to the Buyer on the website. The prices are subject to change without notice, as long as the Buyer has been informed before concluding the sale.

All product prices in euros are inclusive of VAT but do not include post and packaging. These post and packaging fees are calculated according to the required quantities. All rates are available on our website in the “Post and Packaging” section.

 

TERMS OF PAYMENT :

Payment must be made at the time of ordering, either by credit card through the secure payment system on the website (SSL) or by cheque made payable to “SCV LES VIGNOBLES DE CONSTANCE ET DU TERRASSOUS”. Payment must be made so that the SCV LES VIGNOBLES DE CONSTANCE ET DU TERRASSOUS has received the amount by the due date. If the Buyer’s payment is refused at the due date, the Buyer will be required to pay a 39 € administrative fee to cover the costs of the incident.

Prevention of payment fraud :

SCV LES VIGNOBLES DE CONSTANCE ET DU TERRASSOUS reserves the right to require the following documents on your first order :

- copy of a proof of identity (ID card, driving licence, passport…)

- copy of two (2) proofs of home address which are less than three months old (electricity/ gas bill, phone bill, rental receipt)

- copy of company’s registration document (less than three months old) for businesses.

Once these documents have been received and checked you will be sent a mail to confirm your order which will then be dealt with as normal.

SCV LES VIGNOBLES DE CONSTANCE ET DU TERRASSOUS reserves the right to refuse an order placed by a Buyer with whom there may be a dispute or serious doubts.

 

Secure credit card payment.

To provide the most efficient technology we have chosen to use the payment security system of the Crédit Agricole Mutuel bank. Secure payment implies that all transactions made on the Internet are protected against unauthorised interceptions as well as modifications and alterations of the original contents of the messages. This system is based on encrypting all submitted information SSL (Secure Socket layer: secure form filled in by the buyer when submitting his/her bank details). The system used is compatible with most Internet browsers (Netscape and Internet Explorer) and guarantees a totally secure payment.

The payment process is divided into 4 steps as described below :

  1. After filling his/ her shopping basket the Buyer clicks on a means of payment offered by the Seller (with the e-transactions kit). The Buyer is automatically connected onto the payment server, asking for the bank details in order to request authorisation from his/her bank. The information requested is: card number, expiry date and the last three digits on the back of the card.
  2. Upon receipt of the authorisation “e-transactions” simultaneously sends a reply to the seller’s server along with a payment receipt.   
  3. The “e-transactions server” sends the transaction to the bank (credited to the Seller and debited from the Buyer’s account)
  4. All exchanges between “e-transaction” and the Buyer (2 & 3) are encrypted. Only the “e-transactions” server is informed of the bank card number.

 

Payment by cheque :

All payments should be made to SCV LES VIGNOBLES DE CONSTANCE ET DU TERRASSOUS and be addressed to SCV LES VIGNOBLES DE CONSTANCE ET DU TERRASSOUS BP 32 – 66302 Thuir Cedex.
Upon receipt and verification of your cheque, your order will be dealt with as quickly as a credit card payment. Please be aware that if we do not receive your payment within 10 days of placing your order, the order will be considered null and void.  SCV LES VIGNOBLES DE CONSTANCE ET DU TERRASSOUS reserves the right to request a banker’s draft from the Buyer if large amounts of money are involved.  In case of a payment refusal, the Buyer will be requested to pay any fees resulting from this situation.  SCV LES VIGNOBLES DE CONSTANCE ET DU TERRASSOUS reserves the right to cancel any order in case of non receipt of the payment cheque.

 

PROPERTY CLAUSE :

As part of our convention and as the essential condition of any sale, the property of the goods delivered shall not pass to the Buyer until the Seller has received payment for the full price of the goods. 
In case of total or partial failure to pay the price, the Buyer shall return the goods immediately and at his own expense to the Seller as soon as the company has expressed clearly and formally its wish to enforce the property clause here in.

Any deposit or fraction of the price paid by the Buyer will be kept by our company as damages. Notwithstanding this property clause, the goods delivered become the property of the Buyer upon receipt of the goods. It is the Buyer’s responsibility to ensure her/himself and the goods against any damage.

 

JURISDICTION CLAUSE :

 

Any dispute shall be adjudicated exclusively by the Court of Perpignan (66).
